TERMS OF SERVICE

Last updated: 27 October 2026

OVERVIEW

Welcome to KALI.

This website, kalipouches.se, is operated by Kali Brands, a Swedish sole proprietorship owned by Emelie Warås. Throughout these Terms, “we”, “us” and “our” refer to this business.

These Terms apply to your use of our website and consumer purchases made through our online store. Our store is hosted by Shopify.

Please read these Terms together with our Privacy Policy and Return and Refund Policy.

Nothing in these Terms limits your mandatory rights under applicable consumer protection law. If these Terms or another store policy conflict with those rights, mandatory law takes precedence.

Our full business and contact details are provided in Section 25.

SECTION 1 — ACCESS AND ACCOUNT

To place an order independently, you must be at least 18 years old and legally entitled to enter into the purchase.

Please provide accurate and current contact, billing and delivery information. If you discover an error in your order details, contact us promptly.

If you create an account, keep your login details secure and notify us if you suspect unauthorised access.

SECTION 2 — OUR PRODUCTS

KALI offers nicotine-free and tobacco-free pouches.

Product-specific information, including ingredients, flavour, caffeine content where applicable, quantity and storage instructions, is provided on the relevant product page and packaging.

Read the product information and warnings before purchase and use. Follow the instructions on the packaging.

We aim to describe and display our products accurately. Screen settings may cause minor colour differences, but products must conform to their description and applicable legal requirements.

Changes to product descriptions apply to future purchases and do not retrospectively change an existing purchase agreement.

SECTION 3 — ORDERS

Before submitting an order, you can review the products, quantities, delivery details and total price.

After placing an order, you will receive an order confirmation by email. If you do not receive it, check your spam folder or contact us.

If we cannot fulfil an order, we will notify you promptly and refund any payment for products we cannot supply. We will not substitute a different product without your agreement.

If you wish to change or cancel an order, contact us as soon as possible. If dispatch has already taken place, your statutory withdrawal rights may still apply.

For wholesale and business purchases, contact us separately. These consumer Terms do not replace any separately agreed business terms.

SECTION 4 — PRICES AND PAYMENT

Prices are displayed in Swedish kronor (SEK) and include applicable VAT.

The product price is shown on the relevant product page. Delivery charges and any other applicable costs are shown before you complete your purchase.

Available payment methods are displayed at checkout. Where you select a third-party payment service, such as Klarna, that provider’s payment terms also apply.

Price changes do not affect orders already accepted. Any pricing error will be handled in accordance with applicable law. We will not charge a higher price without your agreement.

SECTION 5 — SHIPPING AND DELIVERY

For delivery addresses in Sweden, we offer tracked home delivery through PostNord at a shipping charge of SEK 59 per order.

Available delivery options and the total shipping charge are displayed at checkout before you pay. Any delivery restriction must be stated before purchase.

Order handling times and estimated transport times are provided in the delivery information available before you place your order. If you need delivery by a particular date, contact us before ordering.

Tracking information is provided when available after dispatch. Please ensure that your delivery address and contact details are correct.

We are responsible for products during delivery when you use a carrier offered by us, until you or a person you designate receives them.

If your order is delayed, missing or damaged in transit, contact us using the details in Section 25. We will investigate and handle the matter in accordance with your statutory rights.

Delivery estimates do not exclude your rights in the event of a late or failed delivery.

SECTION 6 — INTELLECTUAL PROPERTY

The KALI name, branding, website text, photographs, graphics and other content belong to us or our licensors, unless otherwise stated.

You may use the website for personal browsing and shopping. You may not reproduce or commercially exploit protected content without permission, except where permitted by law.

Third-party trademarks and content remain the property of their respective owners.

SECTION 7 — OPTIONAL TOOLS

Our website may include third-party tools, such as payment services or account features.

Where separate terms apply to a tool, review those terms before using it.

The inclusion of a third-party tool does not remove our responsibilities to you as the seller.

SECTION 8 — THIRD-PARTY LINKS

Our website may contain links to third-party websites. Those websites operate under their own terms and privacy policies.

We do not control their content or services. This does not affect our responsibility for representations we make or obligations we have under applicable law.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify, which provides the technology that enables us to offer our website and online shopping services.

Purchases from this store are made directly with Kali Brands, not with Shopify. We are responsible for fulfilling your order and handling customer service, returns and complaints relating to your purchase.

Nothing in this section limits any rights or liabilities that cannot lawfully be excluded.

SECTION 10 — PRIVACY POLICY

Our handling of personal data is described in our Privacy Policy.

Shopify also processes personal data in connection with hosting and operating the store. Information about Shopify’s processing is available in Shopify’s Privacy Policy.

Where consent is required for cookies or similar technologies, you can manage your choices through the privacy controls available on our website.

SECTION 11 — REVIEWS AND FEEDBACK

You may submit honest reviews and feedback based on your own experience.

Do not submit misleading reviews, impersonate another person or include unlawful content or personal information about others without permission. Disclose any incentive received for a review.

By submitting a review for publication, you permit us to display it in connection with our products and store, subject to applicable privacy and intellectual property law.

We may moderate unlawful, abusive, irrelevant or fraudulent content. Reviews will not be removed solely because they express a negative opinion.

SECTION 12 — ERRORS AND UPDATES

We aim to keep website information accurate and current.

If we identify an error in product information, availability, pricing or delivery details, we will correct it. If the error affects an existing order, we will contact you and handle it in accordance with applicable law.

Corrections do not give us an unrestricted right to change or cancel an existing purchase agreement.

SECTION 13 — PROHIBITED USES

You must not use our website to commit fraud, impersonate another person, infringe intellectual property rights, distribute malware, obtain unauthorised access or interfere with the website’s security or operation.

You must not submit unlawful, threatening or discriminatory content or misuse another person’s personal data.

SECTION 14 — AUTOMATED ACCESS

Automated tools must not bypass security controls, access non-public information, submit fraudulent orders or interfere with the operation of our store.

Any permitted automated access must comply with applicable law and relevant technical access restrictions.

SECTION 15 — SUSPENSION AND TERMINATION

We may restrict access to an account or website functionality where reasonably necessary to address fraud, unlawful activity or a material breach of these Terms.

Such action does not remove our obligations relating to existing purchases, refunds, complaints or your statutory rights.

SECTION 16 — PRODUCT CONFORMITY AND STATUTORY RIGHTS

Products must conform to the purchase agreement and applicable legal requirements.

You retain your statutory rights concerning defective, incorrectly described or otherwise non-conforming products. These rights apply regardless of whether a separate commercial guarantee is offered.

For products with a limited shelf life, whether a defect exists is assessed with regard to the product’s nature, expected durability, storage instructions and other relevant circumstances.

SECTION 17 — LIABILITY

Our liability is governed by applicable law.

Nothing in these Terms excludes or limits liability for defective products, personal injury, fraud or any other liability that cannot lawfully be excluded or limited.

We do not exclude the remedies or compensation available to you under mandatory consumer protection law.

SECTION 18 — WITHDRAWAL, RETURNS AND REFUNDS

For distance purchases, you generally have the right to withdraw within 14 days, starting on the day after you receive the goods, without giving a reason.

To exercise this right, send us a clear statement using the contact details in Section 25. You may use the standard withdrawal form provided by the Swedish Consumer Agency, but doing so is not compulsory.

Your notification should identify you and the purchase you wish to withdraw from. You do not need our approval to exercise a valid statutory right of withdrawal.

Return the goods within 14 days after notifying us of your withdrawal.

You bear the direct return shipping cost for a change-of-mind return. This does not apply to necessary return costs for a valid complaint about defective or incorrectly supplied goods.

Please package returned goods securely and retain evidence of dispatch.

For withdrawal from an entire order, we refund the product payment and the cost of our least expensive standard delivery option. Additional costs arising from your choice of a more expensive delivery option are not refundable.

We refund without undue delay and no later than 14 days after receiving your withdrawal notice. We may withhold the refund until we receive the goods or evidence that you have returned them, whichever occurs first.

Refunds are made using the original payment method unless otherwise agreed, without a refund processing fee.

A deduction for diminished value may apply only where permitted by law.

Exceptions to withdrawal rights apply only where the legal requirements for an exception are met. Opening packaging does not automatically remove your rights. Any applicable exception for sealed goods unsuitable for return for health protection or hygiene reasons will be explained before purchase.

Further practical instructions are available in our Return and Refund Policy. Your rights concerning defective goods are separate from withdrawal rights.

The return address is provided in Section 25.

SECTION 19 — COMPLAINTS ABOUT PRODUCTS

If a product is defective, damaged or different from what you ordered, contact us promptly.

Include your order details and a description of the problem. Photographs may help us investigate, but do not replace your statutory rights or impose an additional legal requirement.

Under Swedish consumer law, you generally have three years to complain about an original defect. A complaint made within two months of discovering the defect is always considered timely.

This does not mean that a product is guaranteed to remain usable beyond its expected shelf life.

Where a complaint is valid, we provide the remedy required by law and cover necessary costs associated with that remedy, including return shipping where applicable.

SECTION 20 — SEVERABILITY AND INTERPRETATION

If a provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply.

These Terms and the information provided when you purchase form part of your purchase agreement.

Mandatory consumer law takes precedence over conflicting provisions.

SECTION 21 — TRANSFER OF RIGHTS AND OBLIGATIONS

Any transfer of our rights or obligations must respect your existing contractual and statutory rights.

Nothing in these Terms prevents you from exercising or transferring rights where permitted by applicable law.

SECTION 22 — GOVERNING LAW AND DISPUTES

These Terms are governed by Swedish law.

If you are a consumer resident in another country, this choice of law does not deprive you of mandatory consumer protection that applies to you.

Please contact us first if you have a complaint so that we can try to resolve it.

You may also submit an eligible dispute to the Swedish National Board for Consumer Disputes, Allmänna reklamationsnämnden (ARN), through www.arn.se.

You retain your right to bring a claim before a competent court.

SECTION 23 — HEADINGS

Headings are provided to help you navigate these Terms and do not alter their meaning.

SECTION 24 — CHANGES TO THESE TERMS

We may update these Terms for future use of the website and future purchases.

The version applicable to your purchase is the version provided when you placed your order. Later updates do not retrospectively reduce your rights or change an existing agreement without a lawful basis.

The date of the latest update appears at the beginning of these Terms.
